  篇一:租賃合同范本 - 中英文版本

  This Agreement is made at _____, on the _____day of_____ 20__, between _____, hereinafter  called the "lessor" and Mr./Mrs/Miss _____, hereinafter called the "Lessee".

  3. The Lessor agrees to complete repair of the shophouse in accordance with the following details:

  4. On this contract signing date, the Lessor has received a deposit as rent security amounting to_______baht. Should the Lessee be overdue on rent payment for any month, the Lessee agrees for the Lessor to immediately deduct the amount due from the said deposit as rent payment.

  5. The Lessee agrees to pay rent to the Lessor by or before the_____th day of every month. Should the Lessee be in default of rent payment within the said period, the Lessee agrees that this contract then becomes extinct without any notification.

  6. Payment of all building and land taxes shall be borne solely by the Lessee.

  7. Should the shophouse be legally condemned before expiration of the contract, the parties agree that the contract becomes extinct and shall not claim any damages from each other. Provided that the Lessee still resides in the building for which the Lessee shall pay rent to the Lessor until the Lessee moves out of the building and completes handover of the building to the Lessor.

  8. The Lessee agrees to pay rent and all telephone bills to the Telephone organization of Thailand from the day of the enforcement of this contract.

  承租人同意從本合同生效之日起開(kāi)始支付租金,并向泰國(guó)電話管理當(dāng)局繳納電話費(fèi)。

  9. The Lessor agrees that he shall not increase the rent for a period of 2 years from the date of this contract signing.

  出租人同意在本合同簽訂之日起2年內(nèi)不得增加租金。

  10. The Lessor agrees that upon expiration of this contract at the end of the lease period, the Lessor shall allow the Lessee to continue leasing for another period of___years, on condition that the Lessee has not breached this contract in any way.

  出租人同意在本合同終止即租期結(jié)束時(shí),只要承租人不曾違約,出租人可允許承租人續(xù)租____年。

  11. The Lessee agrees to maintain the leased building in good condition and not allow it to further deteriorate. Any modifications or additions carried out on the leased building by the Lessee may be done only with the Lessor’s prior written permission. Any new structure resulting from modification, addition or repair to the leased building becomes the property of the Lessor, and the Lessee cannot claim any damages. This lease contract is terminated should the leased building be subject to a fire disaster.

  承租人同意將所租建筑保持良好狀態(tài),并不得任其損壞。如果承租人對(duì)出租房屋作任何調(diào)整或增添任何設(shè)施,事先必須征得出租人的書(shū)面同意。房?jī)?nèi)任何增添和裝修過(guò)的設(shè)施都成為出租人的財(cái)產(chǎn),而且承租人不得以此向出租人提出補(bǔ)償要求。如果發(fā)生火災(zāi),本租賃合同立即終止。

  12. The Lessee shall permit the Lessor or his representative to enter the leased building for inspection at appropriate times.

  承租人應(yīng)允許出租人及其代表在適當(dāng)?shù)?時(shí)間進(jìn)入該房進(jìn)行檢查。

  13. The Lessee shall not sub-let the building to any other persons, except with the prior written approval of the Lessor.

  除非事先有出租人的書(shū)面許可,承租人不得把該房再出租給其他任何人。

  14. For whatever reason, if the Lessee leaves the leased building, the Lessee agrees

  that he shall not claim any damages or removal costs from the Lessor.

  不論出于何種原因,如果承租人離開(kāi)所租房屋,承租人同意不得向出租方提出索賠或搬遷費(fèi)的要求。

  15. Breach of contract in any regard on the part of the Lessee shall be grounds for the Lessor to terminate this contract immediately; the Lessee shall then permit the Lessor to have right to repossess the leased building immediately.

  第二條  房屋租賃情況及登記備案 Article 2: Rentalsituation and registration

  租賃用途為非居住的,甲方應(yīng)自訂立房屋租賃合同之日起30日內(nèi),到房屋所在地的房屋行政管理部門辦理房屋租賃合同備案手續(xù)。

  If the rentalpurposes is for residence, from the date when this Contract has been set up,within 7 days, Party A should go to the Community Service Station for Foreignerand House Lease (hereinafter refers to as the “station”) to have the houselease contract registered. If the inhabitant is more than one person, Party Bmust inform the situation of inhabitants to Party A. On the other hand, Party Amust establish a register for inhabitants, and send it to the Station complyingwith regulation. If this contract has been amended or terminated, party Ashould go to the Station to change or logout the registration within 5 days. Inthe period of validity, provided the inhabitants have changed, from the date ofchange, within 2 days, Party B must inform the Service Station and change theregistration.

  Party A shouldsupply the related information about himself and/or the house if there isforeigner from other provinces within the inhabitant, to assist and superviseParty B to handle the Temporary Residential Permit at Local Police Station. AndParty B should go to Local police station to handle the Lodging Registrationwithin 24 hours if there is any person from other countries, from the time whenthis contract has been set up.

  If the rentalpurpose is not residence, from the date when this contract has been set up,within 30 days, Party A should go to the department of Local HouseAdministration to handle the Lease Contract Registration filing procedure.

  第三條  租賃期限 Article 3:Lease Term

 。ǘ┳赓U期滿或合同解除后,甲方有權(quán)收回房屋,乙方應(yīng)按照原狀返還房屋及其附屬物品、設(shè)備設(shè)施。甲乙雙方應(yīng)對(duì)房屋和附屬物品、設(shè)備設(shè)施及水電使用等情況進(jìn)行驗(yàn)收,結(jié)清各自應(yīng)當(dāng)承擔(dān)的費(fèi)用。

  乙方繼續(xù)承租的,應(yīng)提前 30 日向甲方提出(√書(shū)面 / □口頭)續(xù)租要求,協(xié)商一致后雙方重新簽訂房屋租賃合同。

  (b) Party A has theright to retract the house upon the expiration of the leasehold or thedissolution of the contract, and, Party B should return the leased house andaccessary facilities in original state to Party A. Both parties must check andaccept the house and the accessory facilities, meanwhile, settle accounts ofthe cost which should be bore by their own.

  If the Lesseeintends to renew the leasehold, should notify (√written/□oral) the Lessorwithin one month before termination. Both parties should conclude a new leasecontract based on the agreement.

  本合同中未列明的與房屋有關(guān)的其他費(fèi)用均由甲方承擔(dān)。如乙方墊付了應(yīng)由甲方支付的費(fèi)用,甲方應(yīng)根據(jù)乙方出示的相關(guān)繳費(fèi)憑據(jù)向乙方返還相應(yīng)費(fèi)用。

  第六條  房屋維護(hù)及維修 Article 6: Maintenanceand repair

  (一)甲方應(yīng)保證房屋的建筑結(jié)構(gòu)和設(shè)備設(shè)施符合建筑、消防、治安、衛(wèi)生等方面的安全條件,不得危及人身安全;承租人保證遵守國(guó)家、   市的法律法規(guī)規(guī)定以及房屋所在小區(qū)的物業(yè)管理規(guī)約。

  (a) Party A shouldensure that the construction and facilities of rental house is conformed torelevant laws and regulations. Party B could not do any unlawful or illegalactivities which are not allowed according to the State laws, the governmentregulations and the local byelaw. In the period of rents, both parties shouldkeep the house, the facilities and goods attached to the house in safe andsuitable.

 。ǘ┳赓U期內(nèi),甲乙雙方應(yīng)共同保障房屋及其附屬物品、設(shè)備設(shè)施處于適用和安全的狀態(tài):

 。╞)In the period of rents, both parties should keep the house, the good andfacilities attached to the house in applicable and safe:

  1、對(duì)于房屋及其附屬物品、設(shè)備設(shè)施因自然屬性或合理使用而導(dǎo)致的損耗,乙方應(yīng)及時(shí)通知甲方修復(fù)。甲方應(yīng)在接到乙方通知后的7 日內(nèi)進(jìn)行維修。逾期不維修的,乙方可代為維修,費(fèi)用由甲方承擔(dān)。因維修房屋影響乙方使用的,應(yīng)相應(yīng)減少租金或延長(zhǎng)租賃期限。

  a.Party B should notice Party A about anydamage of the houses due to poor quality, natural tear and wear or calamities.Party A should be responsible for repairing in 7 days and bear the expenses.Provided Party A has not repaired on schedule, Party B could repair instead ofPart A. Party A should bear the expenses which should be undertaken by himself.Once the repairing has made an impact on the usual life, Party A should reducerental or extend the period of rent correspondingly.

  2、因乙方保管不當(dāng)或不合理使用,致使房屋及其附屬物品、設(shè)備設(shè)施發(fā)生損壞或故障的,乙方應(yīng)負(fù)責(zé)維修或承擔(dān)賠償責(zé)任。

  b.The damage of the premises or thefittings that is within the control of the party B should be borne by party B.

  第七條  轉(zhuǎn)租  Article 7: Transfer or Sublet

  除甲乙雙方另有約定以外,乙方需事先征得甲方書(shū)面同意,方可在租賃期內(nèi)將房屋部分或全部轉(zhuǎn)租給他人,并就受轉(zhuǎn)租人的行為向甲方承擔(dān)責(zé)任。

  Party B should notpartly or totally sublet without the written permission from party A. If thehouse has been transferred or sublet, Party B should be liable for compensatingfor any behavior of sublet person.

  第八條  合同解除 Article 8: Dissolutionof Contract

  (一)經(jīng)甲乙雙方協(xié)商一致,可以解除本合同。

  (a) The contractcan be rescind based on the agreement

  (二)因不可抗力導(dǎo)致本合同無(wú)法繼續(xù)履行的,本合同自行解除。

  (b) If ForceMajeure cause to terminating the contract, the contract is rescinded.

  (三)甲方有下列情形之一的,乙方有權(quán)單方解除合同:

  (c) If Party A hasone of the following behaviors, Party B has the right to rescind this Contractunilaterally.

  1、遲延交付房屋達(dá) 7 日的。

  a Within 7 days,Party A has not turn over the house.

  2、交付的房屋嚴(yán)重不符合合同約定或影響乙方安全、健康的`。

  b The house does notconform to the contract seriously or affects the safety and healthy of Party B.

  3、不承擔(dān)約定的維修義務(wù),致使乙方無(wú)法正常使用房屋的。

  c Because Party Ahas not repaired house, Party B could not use house normally.

  (d) If Party B hasone of the following behaviors, Party A has the right to rescind the Contractunilaterally and take back the house.

  a If Party B delaysrental payment in the excess of _____   days.

  e The damage of thepremises or the fittings that is within the control of party B and party Brefuses to compensate.

  6、利用房屋從事違法活動(dòng)、損害公共利益或者妨礙他人正常工作、生活的。

  f The Party B’sbehaviors in the house are unlawful or interfere with other people’s life.

  7、擅自將房屋轉(zhuǎn)租給第三人的。

  g The Party Btransfer or sublet the leased house unilaterally.

  (e) Other legalsituations of contract rescission.

  第九條  違約責(zé)任 Article 9:Responsibility for breach of the Contract

 。ㄒ唬┘追接械诎藯l第三款約定的情形之一的,應(yīng)按月租金的200 %向乙方支付違約金;乙方有第八條第四款約定的情形之一的,應(yīng)按月租金的200 %向甲方支付違約金,甲方并可要求乙方將房屋恢復(fù)原狀或賠償相應(yīng)損失。

  (a) Either ofParties’ behaviors results in the termination of the contract before itsexpiration, the penalty for breach should be 200% of monthly rental . Party Ahas the right to take back the premises and take actions against party B'sbreach.

 。ǘ┳赓U期內(nèi),甲方需提前收回房屋的,或乙方需提前退租的,應(yīng)提前30 日通知對(duì)方,并按月租金的  200  %向?qū)Ψ街Ц哆`約金;甲方還應(yīng)退還相應(yīng)的租金。

  (b) In the periodof rent, either Party A shall take back the house ahead, or Party B shallreturn the house before the contract expiration, he should informed the otherparty ahead of 30 days. Tort-feasor agrees that the penalty for breach ofcontract shall be 200% of monthly rental. At the same time, Party A shouldreturn the surplus rent.

 。ㄈ┮蚣追轿窗醇s定履行維修義務(wù)造成乙方人身、財(cái)產(chǎn)損失的,甲方應(yīng)承擔(dān)賠償責(zé)任。

  (c) Party A has notrepaired the house in time according to the contract, so Party B’s security hasbeen damaged. Party A should undertake the liability of compensation.

  (四)甲方未按約定時(shí)間交付房屋或者乙方不按約定支付租金但未達(dá)到解除合同條件的,以及乙方未按約定時(shí)間返還房屋的,應(yīng)按  日租金的200%   標(biāo)準(zhǔn)支付違約金。

  (d) Having notrescinded the Contract, but tort-feasor agree that the penalty for breach ofContract shall be 200% of daily rental surpasses one day.

  a Party A shall notturn over the houses on schedule to Party B for use.

  b Party B shall notpay the rental on schedule according to the provisions of the Contract.

  c Party B shall notreturn the house on schedule according to the provisions of the Contract.

  第十條  合同爭(zhēng)議的解決辦法 Article 10: Headling of disputes

  本合同項(xiàng)下發(fā)生的爭(zhēng)議,由雙方當(dāng)事人協(xié)商解決;協(xié)商不成的,依法向有管轄權(quán)的人民法院起訴,或按照另行達(dá)成的仲裁條款或仲裁協(xié)議申請(qǐng)仲裁。

  (a) Any dispute arising from the execution of, or inconnection with, the contract shall be settled through friendly negotiationbetween parties. In case no settlement can be reached, the disputes shall besubmitted to the people’s court, which has jurisdiction over the houses. Orcompelled arbitration in accordance with the arbitration clause or thearbitration agreement.

  (b) This contract will be governed by and construed underthe laws of the People’s Republic of China.

  第十一條  其他約定事項(xiàng) Article 11: Othermatters

  乙方如違反合同規(guī)定,致使甲方未能如期收取租金或?qū)τ诔鲎馕飿I(yè)造成損壞,甲方可扣留部分或全部押金抵付。

  If Party B breaches any Party of this contract.such as not paying the rent punctually,or if party B causes damange to the leased premises,Party A has the right to retain part or all of the deposit in compensation.

  7.費(fèi)用Charges

  租賃期內(nèi)的管理費(fèi)用由__方負(fù)責(zé)支付.

  8.甲方的責(zé)任Landlord’s responsbilities

  9.乙方的.責(zé)任Tenant’s responsbilities

  乙方如在租賃期內(nèi)中途退租,在末經(jīng)得甲方同意下,原押金不予退還。

  If Party B vacates the premises before completion of the tenancy period without any permission of Party A,the deposit will not be returned to Party B.

  租賃期內(nèi)末經(jīng)甲方同意,乙方不能將其所租物業(yè)全部或部分轉(zhuǎn)租,私自轉(zhuǎn)租無(wú)效。

  During the period of tenancy,unless with the agreement of Party A,Party B can not sub-let or let in part or if full the leased premises.

  乙方應(yīng)愛(ài)護(hù)租賃物業(yè)及其設(shè)備,如因使用不當(dāng)導(dǎo)致?lián)p壞,乙方應(yīng)負(fù)責(zé)賠償。

  Party B shall take care of the premises and the facilities of the premisese and shall be responsible for any damages to the premises or the facilitics of the premises owning to the resons of Party B.

  在已有房?jī)?nèi)的裝飾和設(shè)施之外,乙方如要增加設(shè)備或其他裝修征得甲方同意;租賃期滿必須恢復(fù)原狀,并承擔(dān)其費(fèi)用,經(jīng)甲方驗(yàn)收認(rèn)可后歸還甲。

  In additon to the decoration and equipment already in the premises,if Party B wishes to make any alterations or decoration to the premises,Party B shall get consent from Party A,On completion of the tenancy,Party B must hand-over the premises to Party A in its origineal condition and fees arising from such work and to be borne by Party B.

  10.爭(zhēng)議的解決Arbitration

  凡執(zhí)行本合同或與合同有關(guān)的爭(zhēng)議,由雙方友好協(xié)商解決,協(xié)商不成,提請(qǐng)中國(guó)有關(guān)經(jīng)濟(jì)合同仲裁機(jī)構(gòu)調(diào)解,調(diào)解不成,提請(qǐng)中國(guó)有關(guān)經(jīng)濟(jì)合同仲裁機(jī)關(guān)仲裁。

  In the case of disputes arising over this agreement,the two parties shall negotiate in friendly marmer and in good faitb;In failed,shall submit to China Related Economic Contract Arbitrated Bureau to mediate or arbitrate.

  11.其他Others

  本合同如有末盡事宜,由甲乙雙方洽談解決。

  If the contract remain some unperfercted parts,the two parties shall negotiate in peace.

  本合同自簽署之日生效,甲乙雙方各執(zhí)一份參照。

  This contract is effective after both parties making their signatives,each party keeps one copy for reference.

  如有爭(zhēng)議,以此合同中方為準(zhǔn)。

  In case of dispute,the chinese version of the contract shall prevail.
